I cannot say that I agree with the claim that designers get protection. In fact, if the Design Piracy Prohibition Act is put in place, we will see cease-and-desist letters all over the place and a flurry of expensive, time consuming lawsuits with designers arguing over who was the originator of every style, with no method for indexing or verification. The central question is whether fashion design is an ‘art’ worthy of protection, or a craft where product developers have interpreted one another’s work for decades. It has been the U.S. fashion industry’s successful model of creativity for all this time, and upsetting the model makes little sense.
